Quick update on the ongoing Prop 65 situation involving products sold under Dr. Fuhrman’s brand.
A new 60-day notice was recently filed — this time involving kale chips rather than supplements.
As always, it’s important to be precise: a Prop 65 notice is an allegation, not a finding or judgment.
Still, what makes this notable is the broader pattern over time:
• prior settlement involving supplements and allegations of lead and PFOA
• notices involving oats and chia pudding
• now a snack product category
At a minimum, these notices no longer appear isolated to one single product type.
One reasonable question consumers may want to ask is whether companies in the health-food and supplement space should be doing more independent testing and public disclosure — especially when products are marketed around disease prevention, longevity, and “clean” nutrition.
I’m not suggesting conclusions beyond the facts. But I do think transparency matters, particularly in a marketplace built heavily on trust.
